Since September 9th, 2023, collective bargaining agreements (CBA) providing a longer duration than the legal maximum probationary period durations no longer apply.
As of this date, the maximum probationary period durations applicable to employees hired under an indefinite-term contract are as follow:
Employee’s professional category | Maximum duration of the initial probationary period | Maximum duration of the probationary period including renewal |
Workers – Employees (ouvriers, employés) | 2 months | 4 months |
Foremen – Technicians (agents de maîtrise, techniciens) | 3 months | 6 months |
Executives (cadres) | 4 months | 8 months |
The applicable CBA or the employment contract may provide for shorter probationary period durations, which will prevail over those indicated above.
Finally, we remind you that a probationary period can only be validly renewed under strict conditions:
- The possibility to renew must be provided for in the applicable CBA.
- The possibility to renew must be stipulated in the employee’s contract of employment.
- The employee’s express and unequivocal agreement is required for the renewal (i.e. by writing or email).
